Jena 6

I'm usually skeptical about efforts at mass protest, but I can tell you this: One minor success, at least, of Thursday's mobilization around the Jena 6 is that I've now, personally, gone through the following cycle:

• Thursday: confused about all these signs and buttons in my neighborhood about the "Jena 6."
• Friday: reading some stories about the case and pondering the matter.
• Saturday: trying to decide what I should say in my blog post on the matter.

So there you have it, consciousness raised. Unfortunately, I do think there's a lot of truth to what McMegan says here, namely that the best resolution of this situation would be to go back in time and have the school board and the district attorney not handle the early days of the situation much more responsibly. Obviously, though, that's not an option.

What you have now is a situation where you have some black kids getting unduly harsh punishments, and some white kids who've already gotten unduly lenient ones. The problem, again, is that you can't retrospectively tighten up the white kids' punishments, so you'll wind up with disproportionate outcomes unless you end up with an outcome on the Jena 6 case that's probably too lenient on the narrow merits of that particular question. It seems to me, however, that this is what justice demands given the absence of a practical alternative. If you want to read more on this, obviously this blog isn't the place to go since I'm way behind the curve myself, but Color of Change is full of information and action ideas.

Closer to my area of expertise, there's been a lot of commentary in the political media this campaign season about the rise of Barack Obama and the possible decline of race-based grievance politics. I think there's something to that, but as you see with the mobilization around the Jena 6, you're going to keep having race-oriented grievance politics in the African-American community as long as all these grievances keep happening. There's a reason that style of political leadership has long been compelling to black people, it's appeal has waned somewhat as the objective level of grievance has waned, but the persistence of racial inequities in the justice system is very well known and yet white people (myself included) rarely actually say or do anything about it.

Happily for Iverson, Virginia had a black governor at the time, who saw fit to grant Iverson clemency.

Right. I mean what is enraging about MegArdle's response to this is to acknowledge that there is gross inequality in the response from the police, acknowledge that it is the product of racism, and still suggest that it is the black students who are being unduly privileged. For these kids to face sentences of thirty years or more is just absurd. And while I wish we could charge all of the students, white and black, with appropriate punishments-- ones that teach them a lesson without ruining their lives-- since we can't, it seems sensible to have at least a reciprocal sense of justice emerge from giving the black kids the same leniency as the white kids. No, it's not perfect law. But it's the best we can do, given the already horrendous preferential treatment the white students received from the District Attorney.

But, look, you can argue for leniency even setting aside the appalling inequity between the white kids punishment versus the black kids. For an assault in which the victim's life was not seriously threatened and from which he suffered no permanent injury-- and, by the way, from which he recovered well enough to attend a party and drink alcohol the same night-- I don't think that deserves charges of attempted murder, and I don't think that sneakers should be viewed by the law as a deadly weapon.

That's because conservatives have been shouting down anyone who does for so long that most non-yahoos have become weary. Conservatives will openly argue that those inequities are justified. The lock 'em up mentality is in control.

I was just watching "Reefer Madness" on IFC. When I first saw it in 1980 or so it seemed like a pure comedy. My reaction today was more like, "Holy shit - the same stupid pricks are running the country now."

There was no “schoolyard fight” as a result of nooses being hung on a whites-only tree... Justin Barker, the white victim, was cold-cocked from behind, knocked unconscious and stomped by six black athletes. Barker, luckily, sustained no life-threatening injuries and was released from the hospital three hours after the attack... A black U.S. attorney, Don Washington, investigated the “Jena Six” case and concluded that the attack on Barker had absolutely nothing to do with the noose-hanging incident three months before... ...It is rarely mentioned that no black people responded to the jury summonses and that Bell’s public defender was black...

I note also that the MSM coverage doesn't exactly seem fair and balanced, taking the demonstrators' side rather than verifying their claims and asking them why they're supporting what appear to me (with what little I know about the case) to be six thugs who knocked unconscious someone who had nothing to do with the nooses.

Needless to say, I don't expect MattY to look into or discuss fairly the MSM coverage side of things.

People like TLB take quotes out of context in order to buttress a weak argument. Even high school students know you can't get away with that kind of nonsense.
If anyone is interested, read the entire column by Jason Whitlock, a sports columnist. The columnist clearly did not mean for his words to be taken out of context and twisted as TLB has done here.
Congrats Matt,for acknowledging the limitations of your knowledge on this issue and moving forward from there. Megan could learn a lot from your approach. Pontificating about stuff you know little or nothing about is one of the dumbest traps writers fall into.
It would be nice, however, if more people in the blogosphere would speak to issues of race in this country. And that does not mean only paying attention whenever Reverend Al and/or Jesse stick their noses into a particular mess.
Lots of stuff happens and then percolates underneath the surface. Important issues that need to be talked about, like the impact of racism and discrimination in the juvenile justice system. That is where everything starts, and a brighter light on the system would force everyone to take a closer look. If you want to understand the disturbing rates of incarceration of black males, all you have to do is look at what is happening in Jena. It is a perfect example of a racist process that recurs all over the country.

Jesus god... a black student was beaten at an all white party, and only one person was charged with a misdemeanor. Contrast that with 6 students being charged with felony counts, all of which would result, if convicted, with decades-- decades-- of prison time.

If you aren't going to do even the most basic research into what this case is about, don't bother commenting.

Saying they should behave more responsibly is a pretty fucking lame response when it is abundantly clear that they didn't fail to do so out of bad judgment or poor training, but out of blatant racism and a desire to incarcerate black residents of Jena who challenge the still-strong Jim Crow era traditions of the town.

A federal government concerned with justice just might do so.
However, the Bush DoJ's strategy is obvious. They have a token black face - an African-American US Attorney - arguing that they've decided that they should not move in that direction. He cites some nonsense about the difficulty of certifying the white youths in federal court. His excuse is pure nonsense. They could make a case if they wished to do so. Obviously, this DoJ does not wish to do so. And the black US Attorney is clearly accumulating brownie points by being willing to go out in public and spout such obvious nonsense.

The problem is that we're still talking about the kids. This is the problem. The kids reacted in a VERY predictable, and yes, even rational way to the surroundings around them.

It isn't possible to go back in time, however it IS possible to investigate and bring to light the root causes about Jena and see exactly where (meaning who did it) did things go wrong.

Regardless of what happens to the kids (personally, I DO think that all charges should be flat out dropped because they were reacting in a predictable way to threats made against them), something needs to bring this sort of thing to light, and to root it out in all these sick sick communities.

But I suspect that'll never happen.

What are the chances that Justin Barker (or any of the white students who stayed out of school to avoid his fate) will grow up to be lefties like Matthew Yglesias? Pretty slim, huh?

Basically, the reason why people develop lefty pro-black biases is because they have been insulated from the threat of being beaten by young black schoolmates, and so only have the mainstream blacks-as-victims paradigm to draw from. Had Justin Barker gone to Dalton, he wouldn't have been jumped by six black classmates, and he might grow up to automatically consider the blacks the aggrieved party, as Yglesias does. This isn't a new phenomenon.

Forty four years ago, in "My Negro Problem -- And Ours", Norman Podhoretz wrote of his experiences living in close proximity with African American boys:

"To me, at the age of twelve, it seemed very clear that the Negroes were better off than the Jews -- in fact, all whites... it was the whites, the Italians and Jews, who feared the Negroes, not the other way around. The Negroes were tougher than we were, more ruthless, and on the whole, better athletes. What could it mean, then, to say that they were badly off and we were more fortunate?"

Read the rest of the essay. I bet some of the white kids in Jena who have been beaten or intimidated by scholar athletes such as Mr. Bell would relate to it.

While the Jena 6 episode itself is reprehensible, the protest rally in response is indeed heartening.

Hopefully this marks a revival of protest - with labor, healthcare, environmental and antiwar protests spreading.

It's past time that people just said "no" to the nonsense that is going in this country. And there's no need to say "please and thank you" while doing so.

To me, the key takeaway is that organizing a march of 10,000 (at least) in a next door to the back-of-beyond place like Jena is no mean feat, and we can learn from it.

I think Juan's comment quoting NoPod is deeply ironic?

(The tut-tuttery on the Jena episode being "reprensible" bears an resemblance, for me, of the tut-tuttery over the MoveOn.org ad. If only the Negroes could have chosen better victims before making their case! Et cetera.)

Nobody has been calling for the white kids who beat up that black kid to be retried. They've been calling for the black kids to have their sentences lightened. McArdle also keeps dodging the fact that the black kids are being tried for assault with a deadly weapon, where the weapon in question is a sneaker. Drop the charge to simple assault, like that white kid got, and most of this outrage will disappear.

Are you guys using "ironic" in the Alanis Morissette usage (i.e., using "ironic" to describe things that aren't ironic)? If so, are you perhaps trying to be intentionally ironic in a meta sort of way?

In any event, the NoPod essay was about the childhood he spent getting beaten and terrorized by a number of African American and the disconnect this led to as he was being indoctrinated with a progressive script where African Americans were uniformly characterized as victims. It is surprisingly timely even though it was written four decades ago, it has zero to do with Iran, and it is decidedly more honest and introspective than anything I have seen on the subject of race by MY, Megan, or any other white pundits or bloggers.

I dunno, I got the shit kicked out of me by half my school's black population after lunch one day in eighth grade. It wasn't "about" race, it was about respect and french fries, as all the best middle school fights are. And that did kinda fuck with me for a while, that because school was the only place I really saw black people in my white-ass suburb, that meant that essentially every time I saw a black guy I didn't know, I was afraid he was going to beat me up.

But the years kept coming, and those guys grew up alongside me, and by graduation, a few of them were still twats, or dropped out to be bad boys on a professional basis, but the vast majority of them just grew up and out of being schoolyard punks. The thing being, that's what generally happens with kids of all colors, which is why we're traditionally pretty lenient on them. That's the logic behind the white Jena kids' light punishments, and it's good logic, and should be extended to the black kids.

I grew up in 50% black neighborhood, and my high school had a similar proportion of black students. Both were fairly safe but I was in fact beaten up by black kids and fairly often felt threatened. I managed to avoid going through the whole American History X phase and move to straight to being a leftie. So it's been known to happen.

This is not in fact something thought up by whites running newspapers, but a reflection of how some urban blacks view the situation. These same urban blacks are in fact the primary victims of black teenage criminals.

I get were Norman Podhoretz was coming from with that essay. The standard liberal explanation of racism seems to ignore the fact there are lot of situations were being white isn't much of a privilege. That said I was never unaware that there were ways in which blacks had it bad. If I had to think think of a simple explanation for why kid NoPod was unware of what people meant when they said blacks had it bad off I would have to say racism/ ignorance.

Speaking of Sailer though, it's worthwhile to read his latest post on Megan's Jena 6 thread, so I've taken the liberty of pasting it here for you:

"The noose narrative about how there was a direct connection between the incident at the beginning of September and the incident at the beginning of December, which we've all heard a million times by now, was made up long after the events. None of the 40 statements taken of eyewitnesses to the December stomping mention the noose hanging of three months before. Maybe it has some validity, but there's a counter-narrative that fits modern trends and is being ignored.

It's fascinating how so many people assume the Jena Six were despised, marginalized outcasts whom the White Power Structure was just itching to send to prison. In reality, they were Big Men on Campus who had scored at least 29 touchdowns among them in the 7-3 season that had just ended in football-mad Jena.

And they had long been acting like they were above the law, since the school authorities wouldn't suspend them from the team because they were such good players. In the 12 months immediately prior to his stomping the unconscious Justin Barker, All-State star Mychal Bell had scored 18 touchdowns and been convicted of four earlier crimes, two of them violent. He wasn't the only one of the Jena Six with a criminal record -- he's just the only one who's juvenile record has been unsealed so far. Eddie Thompson, a Jena minister, wrote of the six friends "reign of terror:"

"Some of these students have reputations in Jena for intimidating and sometimes beating other students. They have vandalized and destroyed both school property and community property. Some of the Jena Six have been involved in crimes not only in LaSalle Parish but also in surrounding parishes. For the most part, coaches and other adults have prevented them from being held accountable for the reign of terror they have presided over in Jena. Despite intervention by adults wanting to give them chances due their athletic potential, most of the Jena Six have extensive juvenile records. … These boys did not receive prejudicial treatment but received preferential treatment until things got out of hand."

But they were protected by the school authorities. Abbey Brown reported in the local newspaper on August 25:

"Mack Fowler, Jena High's football coach at the time, said that … he discovered that while he was punishing his players, the school 'wasn't doing anything' to them. Fowler said he decided then that he was going to do the same thing the school did — nothing."

In stomping the unconscious kid on December 4, 2006, the Jena Six had finally gone too far, and they got the book thrown at them.

So, which narrative sounds more like 21st Century America -- your beloved one where it's 1877 and the Klan is about to ride, or this one?"

There's this amazing thing called Google that let's you look up the facts for yourself and not just get spoonfed stories by the national media. For example, you can read Abbey Brown's coverage of the story as it unfolded in the local newspaper, the Alexandria-Pineville Town Talk, which gives you a very different picture than what the TV bigfeet who just parachuted into Jena are telling you. For example, in her Aug. 25 story "Bell denied bond due to criminal history:"

"Three months prior to that attack, [Mychal] Bell committed two violent crimes while on probation for a Christmas Day battery in 2005, according to testimony. Later that same week, he led the Jena Giants to a shutout victory in a football game against the Buckeye Panthers."

"Bell was adjudicated -- the juvenile equivalent to a conviction -- of battery on Sept. 2 and criminal damage to property on Sept. 3, said Cynthia Bradford, LaSalle Parish deputy clerk."

"A few days later, on Sept. 8, Bell rushed 12 times for 108 yards and scored three touchdowns -- one of the best performances of the year for the standout athlete."

There was also his conviction of July 25, 2006 for a property crime, just before Hell Week, but none of that seemed to phase the school's white male power structure.

In 21st Century America, we cut celebrities a lot of slack because ... they're celebrities! (By the way, can you believe that Phil Spector might get away with a hung jury? I remember the Ramones telling everybody he was a dangerous gun-waving loon in 1980.)

And we cut young blacks a lot of slack because nobody wants to be accused of being racist or get sued for discrimination, and lots of white people like to accuse other white people of being racist because it makes them feel so good inside.

So, with black athlete celebrities (which the Jena Six were on a very local scale in little football-crazy Jena), we end up with the Venn Diagram from Hell. As long as they run amok on the field, they're allowed to run amok off the field. Until, finally, some of them go too far (as six football players stomping an unconscious kid turned out to be) and then the full weight of the law comes down on them.

Jason Whitlock, the outstanding sportswriter, has been covering this topic for years, and his conclusion is pure common sense: if you don't want star athletes committing bad crimes, you've got to discipline them as they're growing up. And their fathers have to play a bigger role.

It always amazes me that this "liberal" blog attracts some of the most insidious racists known to to the blogosphere. I know the arguments for free-speech and I support them. But Steve Sailer and his acolytes are to black people, what Holocaust deniers are to Jews. The very idea that people seriously debate and quote from a guy who believes blacks to have "poorer native judgment," is an enormously depressing statement on race in this country.

To the issue at hand, incidents like the Jena 6 will keep happening until black people seize some modicum of economic power and prevent them from happening. For instruction, all we need do is examine the fate of the recently jailed Mike Nifong. When it comes to racism, most white people could care less. Not because they're racist, but because they're human and humans tend to be generally self-interested.

The problem with black folks is we repeatedly expect other people to care as much about us, as we should about ourselves. We see our problems as a AMERICAN tragedy, as opposed to the personal tragedy which they really are. Hence we lean on protests in the hopes that whites will become as outraged as we are. Good luck with that. At the end of the day, people only respect one thing--power. Black people lack it. And nothing will change, until that simple fact does.

As we can see from the above comment, Jena is, in part, about payback for the exposure of the Duke lacrosse hoax.

In the Duke case, there was a lot of valid commentary about how lacrosse players often act like jerks because they are minor celebrities as athletes (of course, they are on a big campus with America's best basketball program, so it's pretty relative compared to, say, the Cincinnati Bengals). But nobody besides Jason Whitlock, Abbey Brown, and the Rev. Eddie Thompson was talking in the media about how the Jena Six were privileged celebrities in tiny (3,000 person) Jena, where football is king, and thus they got away with a lot of crimes until they went too far.

Have you even been to Duke? It's not a huge campus, it has a small undergrad population, and the lax players are gods there (I know how lax players are seen in the ACC because I went to one of Duke's main rivals in the conference and we have one of the top programs in the country). I had friends and frat brothers who played lax and let me tell you...they were among the most well off and coddled people on the campus and I doubt they would disagree.

Myself being a black man, I have no problem with people saying that within the African American community, there needs to an emphasis put on accountability. There does and I think most black people would agree with that. And if these kids were wild athletes that did something out of line, then, yes, they should be punished.

But that doesn't excuse the blatant racism that provoked nooses being hung in a tree and it certainly doesn't excuse the strange racists thoughts floating around in some of the comments here.

Sailer, I don't get as incensed as others, since you do a lot of interesting grunt work chasing down stats and things i would otherwise never see. But this really seems to be a stretch.

Can you explain why Carwyn Jones, Bryant Purvis, and Theo Shaw should have been charged with attempted murder? Of a kid who managed to attend his own ring ceremony later that night? Your implication seems to be that because Bell's a bad kid, and Bailey's a little shady, we should be okay with locking them all up for decades. Why? Because they played football together?

Remember...
David Duke was elected to the Louisiana State House as a representative.
The guy was almost elected Governor of the state.
He's ran for other state-wide offices and received in the range of 15-20 percent of the vote. Consistently.
Remember, he is one of the most well-known racists in the country. A former KKK Grand Dragon.
During the middle of the Katrina tragedy, armed men refused to allow African-Americans to cross a bridge that would have allowed them to reach safer ground.
That is Louisiana. And everything that happens in the state has to be looked at with that reality in mind.

Davidc - I find it interesting that you mention the nooses were painted in school colors and were apparantly intended on "supporting" a football theme of "Hang the Cowboys" - a rival town's team coming in for a visiting game.

And apparantly no protests until early September when two black on white racial fights led a black religious-community activist group to claim it was "those nooses". Which led to a full police and FBI "hate crime" investigation which found there was none.
Althouse is right. The reporting, like in the Duke case, has been very poor.

And expanding, it is the media again trying to force a story into it's patented "racial suffering of blacks and their justified outrage" metanarrative . Again willfully ignoring the facts of the case available to any reporter they dared send with an open mind to interview people. Which none of them did, as with the Duke case.

The media and black leaders tried to argue its still the 1920s in the Deep South, whites are terrorizing "innocent blacks", and lynchings haunt the landscape.

In fact, in most American's lifetimes, it is not blacks who are the hunted. They are the hunters. In the "Color of Crime", a statistical study - A white is 12 times more likely to be murdered by a black than the reverse. A black victimized by an armed non-black robber is 38 times less likely than a white, hispanic, or Asian being held up at gunpoint by a black thug. A white woman who is raped now has a 50-50 chance her attacker was black. Black women have a one in 130 chance their rapist will be a non-black.

But media, the old black leadership, and guilty white liberals prefer instead to pretend that the present reality is one where innocent blacks cower in fear of school lynchings and KKK riding and guns, not the people misusing them, are the problem. Or, desperately feel compelled to prove they are not evil racist whites as they are indoctrinated by seeking in any crime to establish a "moral equivalency" when black thugs are involved. Sure he is a black thug with multiple rapes and assaults and robberies, but he is no worse than the white racist society that forces him to act like that....

School officials are notorious about not publicizing their criminal stats, student on teacher threats or violence, classroom disruptions - but sociologists and educators in conferences and in papers admit that "agressive young black males" are the most daunting problem they face in "diverse schools".

But with the Jena 6, we have the press, black activists, and guilty whites desperately trying to tie the nooses and "life sentences the noose makers should have gotten" to a racial attack 3 months later that judge, jury, FBI, US Attorney, police investigators determined was not in the thoughts of the 6 black athlete attackers at all.

Another curious bit is a few white Lefties and females in the media who have never been in a fight or know how to fight claiming the stomping was of little consequence because the "attackers were wearing soft white tennis shoes" and "it's not like the victim was really hurt". (The victim was told to stay in the hospital overnight, he had a special ceremony he wanted to go to against doctors advice. His family, lacking health insurance, had 12,000 in bills from the neurological care, emergency care, and tests and were concerned about their ability to pay for a hospital bed)

The facts are that military combat instructors say that the "stomp" has 6-7 times more power than a full punch. In hand to hand training or reality, the killing or disabling blows focus in knocking a person down and delivering the final blow to the head, face, or throat. Preferable with a weapon, if none, then a foot, then an elbow, then a knee, and only if the other methods cant be used - a fist or open hand.

And those blows make little difference in the power applied if delivered barefoot, with "soft shoes", or with hobnailed storm trooper boots. A person who is a lawyer commenting on this remembered his city obtained convictions of 5 blacks who stomped another dug dealer to death in part from sneaker marks on the victims head and face and blood tracks the sneaker soles made leading away

The 6 black athletes had at least 4 members with criminal records for violent crimes. One was convicted of a past arson. One, whose records are sealed, is purportedly convicted of sexual assault on a 12-year old girl when he was younger. But because they were "great athletes" that made for a winning football team, black and white boosters, the local courts, coaches - all tried to ensure they remained in school.

Remember it wasn't just about the "lack of justice " for the "innocent 6", as black and white activists call them, the investigation as to who burned down half the high school continues...and two of the "Jena 6" are suspects. And investigations as to who was making death threats at the school and phoning the kid and the "3 noose hangers" with similar threats continue. And threats blacks made to other whites at school that if they showed up, they would die (reportedly invoving 2 of the 6 black athletes that a local minister said were allowed to conduct "a reign of terror" against schoolmates...
And one of the Jena 6 not in jail is suspect in 2 other violent assaults, and has convictions for 4 other significant crimes as a juvie.

Finally, the actions of the local DA make a lot more sense if it is true, as implied, that the only way to get a juvie on a violent rampage in the adult system better able to handle him was by overcharging the crime, then dropping charges in his racial attacks down to more sensible charges of aggravated battery, conspiracy to commit battery. The ringleader he wanted, Mychal Bell, was free at the time and school not notified by the juvenile system despite charges of two other violent assaults. And ability to more freely interrogate and prosecute the other 5 thugs in the adult system did offer the potential of ending the racial attacks and arson through intimidation. This was also only one week after one white kid could have been killed in a race-related gang stomping by strong athletes, an incident involving a struggle for a gun betwen a white kid and 2 of the Jena 6, and with half the high school burned and smoking......

I think once the details are fairly presented, the black leaders and local black activists will look like the bigoted assholes they were in the Lacrosse case. The media will again be exposed for pursuing their agenda and approved liberal narrative, not reporting on the facts. The town will be faulted for both enabling the black thugs to keep playing football as well as nailing them more harshly than whites because they had past extensive criminal history. The arson of the HS will continue to be investigated. Guilty white liberals and academics will again have their vapid "white oppressor" denunciations reposted and ridiculed - as with the Lacrosse case and dozens of others - when facts are better known.

The interesting question is whether anybody ever learns anything. The people expressing hatred and loathing over Jena today were the same people who fell hook, line, and sinker for the Duke lacrosse hoax. But their humiliation over Duke hasn't made them more cautious or more skeptical, it's made them more desirous to find an anti-Mike Nifong to crucify.

Now, the Jena narrative we've been fed by the national media doesn't appear to be a pure hoax like the Duke lacrosse story that the New York Times trumpeted over and over again in the spring of 2006. Instead, it's more of a selective cherrypicking of certain events that was constructed well after the fact, along with complete oblivious to other relevant events in order to appeal to deep prejudices in today's national audience. So, I guess we're making some progress ...

Let's contemplate a photographic negative story. Let's say that six white star football players had stomped an unconscious black student in Jena. What would have turned out different last Thursday?

Almost nothing, I suspect. The Revs. Jesse and Al would have led the same demonstrators in the same protest against white racism. There would just be tiny differences, like the signs wouldn't read "Free the Jena Six." They'd read "Jail the Jena Six." And the civil rights leaders would be denouncing DA Reed Walters for lowering the charges from attempted murder to aggravated battery. And Jesse and Al would be demanding that the hate crime charges be added to the indictments.

One thing that would be different would be that there would be a huge amount of talk in the national media about how the white football players had been running amok off the field for years and the coach and principal had been turning a blind eye to their crimes to keep them on the team.

But, otherwise, very little would be different.

Why use the perjorative whiteboy for an innocent kid going about his business who was jumped, attacked, stomped, and hospitalized by 6 black thugs who targeted him on race?

1. As I mentioned, it appears the DA over-charged to get several violent thugs unchecked by the juvenile justice system into the adult system before they killed somebody in race attacks or arson.

2. The damages were severe enough that 12,000 dollars worth of care and neurological work was done because his condition was assessed as possibly life-threatening.

3. When 6 powerful athletes gang stomp an unconscious boy about his head - the intent is there to further injure him past just "winning a fight" or knock him out. The intent was to badly injure, kill.

4. The weapons used were feet. In 15% of homicides in the US, the lethal force comes from feet or fists.

5. The medical tests showed no brain bleeding, no brain swelling, no nerve damage to facial muscles, no bones broken by the thugs. Because the "Whiteboy" lacked free health care from welfare and health insurance, his family was very concerned how much the attack by likely indigent blacks they couldn't sue would cost them. The kid, Justin, defied doctors and wanted to go to senior ring ceremony and feared how much he was costing his parents being there.
Later, he has some permanent damage to his right eye.
The fact that he was discharged and told he was lucky to be alive without more than his eye and concussion damage does not "prove" the 6 blacks did not intend death. Maybe they only meant to badly injure him after he was unconscious. That is for investigators and juries to decide...

Completely illiterate may be a stretch, but let me try to re-phrase Chris Ford's argument for you.

Chris Ford's theory is that the D.A. may have initially over-charged the defendant Mychal Bell in order to get him into the adult criminal justice system, since Bell's previous convictions in the juvenile justice system had done nothing to stop his continuing trend of violent offenses. Ford also provides context for the D.A. taking this tack by pointing out that he did this in the wake of a six-on-one beating that sent a student to the hospital and an arson attack that burnt down half the school.

In other words, rather than being driven by racism, the District Attorney may have been initially more severe in his charges against the Jena Six out of concern for the well-being of the rest of their fellow students, and the community, since key defendants' repeated interactions with the juvenile justice system hadn't deterred them from committing additional violent crimes. Once the defendants were safely in the adult criminal justice system, the D.A. reduced their charges to more appropriate ones.

The question Chris Ford's theory suggests is this: What if the District Attorney had let the assault on Justin Barker be dealt as previous incidents had been, by the juvenile justice system, and the next time the Jena Six stomped an unconscious boy's head on the concrete they caused permanent injury or death? The D.A. would have rightfully been criticized for his leniency after the previous assault, in light of Bell's earlier history of violent crime, and the juvenile justice system's apparent inability to deter him.

The one member of the Jena Six who was so young (14) that the DA couldn't wrestle him out of the juvenile justice system and into the adult justice system is already back on the football field and, in Mychal Bell's absence, is now one of the stars of the Jena HS team. Abbey Brown reported earlier this month in "'Jena Six' all ran together -- on the field and off:"

"Since returning to school, Beard has shined as one of the Jena Giants' star players on the football field. … He had 91 yards rushing and scored the game-winning touchdown Friday night in the Giants' 12-6 overtime win over Iowa."

How about illiterate beyond comprehension? Is that fair enough? Obviously Chris Ford is no lawyer, but then neither am I. Are we all in agreement that these boys are innocent of attempted murder? Is it not possible to get a juvenile into the adult system without bringing a charge of murder? Have any arson charges been brought against this boy?

Rather than defend the illiterate Chris Ford, are you, Fred, willing to defend this prosecutor? If you subscribe to Ford's illiterate theories, then you'll no doubt want to see every DUI and rape accusation charged as attempted murder. Prosecutors do not protect people from future criminal actions. Prosecutors convict people of past actions. Just like Nifong, they need to be held accountable for the charges they bring. These sorts of games with people's lives are inexcusable.

My impression is that in Louisiana an attempted murder charge would get a 16 year old out of the juvenile justice system and into the adult justice system, while an aggravated battery charge would not. If so (a big if), then the DA was trying to get the Jena Six out of the juvenile system that had so clearly failed to protect the public from them (as evidenced by how Mychal Bell's four juvenile convictions over the previous year hadn't kept him from scoring 18 touchdowns during the football season that had just ended).

The one stomper who was too young to be tried as an adult rushed for 200 yards in the first two games of this season, so he's back doing what he likes to do. So, you can see why the DA would want to initially file an attempted murder charge even though he actually went to trial on aggravated battery.

- Jena does have racial problems. Jena does have bigotry and prejudice, just like every other town in America, perhaps even worse than some. If there were no racial problems, there would have been no nooses hung from a tree. There would not be one white student beaten and six black students charged with attempted second-degree murder. The local ministers would not have hurriedly called a meeting to deal with the issue. The cameras of the world would not have focused their lenses on Jena.

- The actions of the three white students who hung the nooses (on a tree at the high school) demonstrate prejudice and bigotry. However, they were not just given "two days suspension" as reported by national news agencies. After first being expelled, then upon appeal, being allowed to re-enter the school system, they were sent to an alternative school, off-campus, for an extended period of time. They underwent investigations by Federal and Sate authorities. They were given psychological evaluations. Even when they were eventually allowed back on campus they were not allowed to be a part of the general population for weeks.

- There was no "fight" on December 4, 2006 at Jena High School, as the national media continues to characterize the event in question. Six students attacked a single student who was immediately knocked unconscious. According to sworn testimony, they stomped him, as he lay "lifeless" upon the ground.

- Justin Barker, the white student attacked, was not the first white student targeted by these black students. Others had been informed they were going to be beaten, but stayed away from school and out of sight until they felt safe.

- CNN reported that there were "obviously no witnesses to the fight." In fact, over thirty eyewitnesses, students and teachers, were questioned immediately following the attack, all of who implicated one or more of the black students arrested in the case. In fact, some of the accused black students did not stop stomping Barker until they were pulled away from him by some of the teachers, according to testimony given in the trial of Mychal Bell.

- The media continues to make the point that Justin Barker "attended a party" later that evening, insinuating that his injuries were not very severe. The Barkers, by no means a wealthy family, face medical bills already over $12,000 from the emergency room visit. Imagine what an overnight visit would have cost. Justin Barker was advised to remain hospitalized but decided he would not let the event keep him from participating in the once-in-a-lifetime, traditional Ring Ceremony at First Baptist Church in Jena, where class rings are presented to the upcoming senior class.

- The fight on December 4 was unrelated to the noose incident, or any other incident that occurred earlier in Jena that week. The media keeps reporting otherwise. There are three different boys named "Justin" involved in three different events that the media have morphed into the "Justin" who was attacked on December 4:

A. A juvenile named Justin, whose name was not released to the media, was one of the boys who hung nooses from the trees in September.

B. Three months later, Justin Sloan, not a student at Jena High, fought with one of the black students, Robert Baily, at the fair barn when a couple of black students tried to enter a private party. The next evening, at "Gotta Go" store, Justin Sloan and Robert Baily confronted one another in the parking lot. There were two other black students with Baily. As they ran towards Sloan, Sloan rushed to his truck to get a shotgun, which the black boys wrestled from him and fled.

C. On December 4, six black students at Jena High School attacked Justin Barker, who is neither of the previously mentioned young men.

- The speech given by [District Attorney] Reed Walters that included the now infamous statement "I can end your life with the stroke of a pen" was not given to a group of black students. It was given during a speech to the entire student body in an assembly called by the school's principal to calm a community that was pulling their children out of school because there were two fights one day with racial overtones. Two girls, one white and one black fought. Another student was taken to the emergency room to receive stitches.

- The national news media has not mentioned a single time that there was an FBI investigation into the hanging of the nooses and the conduct of Reed Walters that concluded there was no criminal activity or "hate crime" involved. The report is available to the media, along with court records and sworn testimony, none of which has been reported.

- It has been reported that the school has two standards of justice since white students who attacked a black student were not treated as the black students who attacked a white student. No group of white students attacked a black student at Jena High School. Fights that have occurred have always been handled equally. This was not a fight. This process was taken out of the hands of school officials when the ambulance was called to bring Justin Barker to the hospital for the attack. Both the appearance of the ambulance and Barker's visit to the emergency room requires an investigation by law enforcement.

- The "Jena Six" have repeatedly been held up as heroes by much of the race-based community and called "innocent students" by the national media. Some of these students have reputations in Jena for intimidating and sometimes beating other students. They have vandalized and destroyed both school property and community property. Some of the Jena Six have been involved in crimes not only in LaSalle Parish but also in surrounding parishes. For the most part, coaches and other adults have prevented them from being held accountable for the reign of terror they have presided over in Jena. Despite intervention by adults wanting to give them chances due their athletic potential, most of the Jena Six have extensive juvenile records. Yet their parents keep insisting that their children have never been in trouble before. These boys did not receive prejudicial treatment but received preferential treatment until things got out of hand.

- The entire black community of Jena is not being heard in this controversy, just the parents, relatives, and close friends of the Jena Six. The black community of Jena has not been involved in the protests and demonstrations called by national race-based organizations. Some state and national race crusaders have chastised them for not "rising up" with the parents to force law enforcement to "free the Jena Six." Many do agree that the charges seem wrong, but they also know the criminal history of the boys referred to as the "Jena Six." It is their neighborhood these boys have terrorized. Not even all of the parents claim that these boys should be set free with no consequence for their actions. One of the parents was interviewed, saying that the boys should suffer the fair punishment for their actions. He suggested that simple battery would be an acceptable charge. With one exception, the local black pastors do not support the demonstrations. They have been openly criticized for their lack of cooperation with the national race crusaders. One of them counseled the "Jena Six" families to not stir controversy for controversy's sake. The black pastor was openly condemned by a local radio personality sympathetic to the cause of the black parents. The rhetoric grew so intense that the black pastor was referred to as Reed Walter's "house Negro" on the local radio talk show. The pastor is consistently accused on this show of working in cooperation with Reed Walters in a plot to undermine the "Jena Six."

Conclusion:

To Reed Walters: Charge these young men with the crimes of which they are guilty.

To The Parents: Hold your children accountable for their actions.

To The White Community: Stop claiming, "There is no racism here" or "We have no problems here." Live by the Golden Rule: Do unto others as you would have them do unto you. If twelve percent of our community is feeling estranged, we should listen to their grievances.

To The Black Community: If you believe these six black students are innocent, we can "free the Jena Six" today by having the black students, who thirty witnesses testify attacked Justin Barker, step forward and take responsibility for their actions.

To The National Media: Please, get it right. Report the facts. Let them take you to the truth. Stop making Jena, Louisiana, a national scapegoat for America's sin of racism.

To America: Judge not unless you be judged. You will be judged by the same measure you judge this little town. Until you know the facts, reserve judgment. Do no believe everything you see on TV.

The recent FBI and Justice Department study concluded the following:
Blacks are more likely than whites or Hispanics to be victims of crime.
Blacks are more likely than any other group to be victims of "serious violent crime," such as rape, assault and robbery.
Blacks were more than twice as likely as whites to be confronted with a firearm during a crime.
In more than nine out of 10 cases, black victims are murdered by fellow blacks.
Blacks commit more violent crime against whites than against other blacks.
Forty-five percent of the victims of violent crime by blacks are white folks, 43 percent are black, 10 percent are Hispanic.
Blacks are seven times as likely as people of other races to commit murder, eight times more likely to commit robbery and three times more likely to use a gun in a crime.
Blacks are an estimated 39 times more likely to commit violent crime against a white person than vice versa, and 136 times more likely to commit robbery. (If decent black folks have trouble hailing a cab, and they do, these numbers may help explain it.)
Black-on-white rape is 115 times more common than the reverse.
What do these statistics tell us? The real repository of racism in America -- manifest in violent interracial assault, rape and murder -- is to be found not in the white community, but the African-American community. In almost all interracial attacks, whites are the victims, not the victimizers.

Just to be clear, Jena 6 is in no way "payback" for Duke. The Duke case was a disgusting bit of race-baiting by a demagouge. I raised to point how people with economic power handle their business. The Duke Lacrosse cats needed no mass marches to right an obvious injustice. What they needed was the best legal team money could buy, to deal with a prosecutor who was out of control.

The isuse isn't payback. It's the differing responses to injustice. Obviously the families economic means differ. But if you get 10,000 people down to Jena, you could probably raise a lot of money over the net to get those boys some damn good legal help.

- Justin Barker, the white student attacked, was not the first white student targeted by these black students. Others had been informed they were going to be beaten, but stayed away from school and out of sight until they felt safe.

Pray tell, why were these white boys targeted? You make it sound like this is random violence, that the Jena 6 attacked this poor defenseless Justin simply because he was a whiteboy in the wrong place at the wrong time. Surely the others must have been informed why they were going to be beaten before they stayed away.

Funny how the racists want to equate the severity of injuries with the cost of health care. They cannot say he had anything more than bump and bruises, so they throw out a dollar figure that is supposed to be astounding and always qualify it with the fact that the Barkers are white trash and can't afford it. It sounds to me like this is more of an argument for nationalized health care. The ambulance ride alone costs thousands of dollars.

The speech given by [District Attorney] Reed Walters that included the now infamous statement "I can end your life with the stroke of a pen" was not given to a group of black students.

There are plenty of witnesses who say the DA was looking right at the group of black students when he said this famous phrase to the school assembly. No doubt everyone understood his meaning.

According to the investigating FBI agent, they did believe that a hate crime had occurred, however these boys did not have the requisite history of hateful acts needed to prosecute a hate crime. He no doubt should have charged them with attempted murder and then reduced the charges at the trial.

Conclusions:

Steve Sailor is a racist whose impression is always that blacks are inferior. If he had his way these animals would all be locked up in zoos rather than prisons. For Sailor, it is acceptable for a DA to get creative with his charges in order to get black men (who are an obvious danger to society) off the street. If a DA should get creative with priviledged white college students, however, it is an outrage to be brought up at every opportunity. What's the over/under on the number of Sailor comments before we get a mention that OJ was guilty?

It's a shame that today in the world we are still paying for events that have occured over 140 years ago. Why is it that anytime a white person is involved with a black person with a disagreement or a view, the white person is always racist. Yet, we let blacks act racist, talk racist, and be racist and all we can do is sit there and not say a word in fear of being racist. I am very ashamed that we as white people still coddle blacks and make them the defenseless beings that we have. Thank God the Jews never asked for the same coddling for all of there hardships. Egyptian enslavement, racial cleansing, and always being the scapegoat for all the worlds problems. We would owe them the world by now. I guess they are just stronger as a race of people that can move on through any rough times. I wish the blacks could learn from the Jews.

Well, Steve Sailer presents us with a great deal of "facts" that enjoins us to reconsider our leftist "white guilt". Apparently Google (along with Wikepedia) is the "arbiter of truth" from which the MSM (and us lesser mortals) may learn a thing or two.

It's funny, when you reread Steve's "facts", you quickly realize that all of them are actually opinions or simply regurgitations of "witness" accounts. And we all know how reliable witnesses are, no?

Now I don't live in Jenna, nor do I know the criminal histories of ALL the kids involved in this series of tragic incidents. I do not know (nor do I pretend to know) the states of mind of all the assorted participants. But I do know "axe grinding" when I smell it.

Seems like Steve (are you a resident of Jenna, Steve?) is spending a great deal of time rationalizing the behavior of the white kids while condemning those who believe the black kids (regardless of their past and present actions) are being treated unfairly.

Despite the veracity of the information we can find with a swift scan of Google; I doubt very much that we will ever know the fundamental "truths" of the incidents at Jenna. I doubt that we can ever know the "truth" of anything since we cannot read the minds of those involved. My preference is analyzing the words and actions of those who purport to speak the "truth" about such issues.

That said, "Just Karl" seems to suggest that the FBI agent involved seems to think that, yes indeed, a hate crime was committed despite the fact that no charges were brought. If this is the case, then this "witness testimony" appears to call into question all of the other "unbiased" reportage you've so kindly provided....

Oh, and "d", it's context, context, context...

You are misrepresenting the facts. The text you attributed to Sailer was written by a black journalist, Jason Whitlock. The full text of his column is here: "Lessons from Jena, LA". Before you transfer your accusations of racism to Whitlock, read his whole column.

BTW, as Whitlock points out, the white kid attacked by the Jena Six had nothing to do with the noose affair three months before, that was a different white kid with the same first name. Also, none of the dozens of witnesses to the attack on Barker mentioned anything about the nooses (i.e., none of them heard the attackers claim the were stomping the unconscious barker because of the nooses that had been hung on a tree three months earlier).

In any case, why the false equivalence between an act of hate speech (the nooses) and the stomping of an unconscious boy's head on the concrete? How could the first ever excuse the second?

So, the question I have at this point is whether anybody out there feels they have learned anything from the exposure of the Duke lacrosse hoax and from the facts that have come out about Jena showing that, while by no means a hoax, it's a much more ambiguous story than was widely reported.

Who'd have thought that, after the daily match, sitting down to a glass of cherry and enjoying an relaxing evening of "performance art" might have sullying affects upon one's reputation.

I find it outrageous that anyone would dare assume that participating in such wholesome activities might lead one to think that those young lads were capable of such heinous and boorish behavior. Or that that scurrilous harlot, having been fairly compensated for her "services", would have the gall to insinuate, without cause and without reason, that the moral fiber of those fine young men wasn't above reproach. You just can't find trustworthy "help" these days...

One can imagine that in future years, when high-fiving their "bros" about the latest "babe" they "tagged" while working in their fathers place of work, that the joy they might have normally felt is tempered by a remembrance of innocence lost as an invisible tear rolls down their apple-cheeks.

ESPN: According to several witnesses, junior Justin Barker, a white student, had taunted Bailey during lunch, mocking him for the beating he received at the predominantly white party a few days before. Several witnesses later told police Barker also used racial slurs, including the n-word.

Barker walked out of the gym after lunch, into a covered walkway and, according to dozens of witnesses, a fight broke out.

ESPN has reviewed more than 40 witness statements relating to the fight. Several indicate Bell punched Barker from behind, instantly knocking him to the concrete walkway. Witnesses say a group of black students then stomped on Barker, kicking him in the face and head as he was on the ground.

"He was lifeless when they put him in the ambulance … they thought he was dead," Fowler said.

According to hospital records, Barker's injuries were not as severe as initially feared. He was knocked unconscious during the fight and bled from both ears. But Barker spent a little less than three hours in the hospital and was healthy enough to attend a school ring ceremony that same night.

B. Three months later, Justin Sloan, not a student at Jena High, fought with one of the black students, Robert Baily, at the fair barn when a couple of black students tried to enter a private party. The next evening, at "Gotta Go" store, Justin Sloan and Robert Baily confronted one another in the parking lot. There were two other black students with Baily. As they ran towards Sloan, Sloan rushed to his truck to get a shotgun, which the black boys wrestled from him and fled.

What he does not say is that Sloan attacked Baily with a beer bottle and was charged with simple battery. So to the DA in Jena a beer bottle and shotgun = simple battery, while tennis shoes = deadly weapon.

It's easy to understand the confusion over the Justins. One hung nooses, one assulted a black youth with a beer bottle at a whites only party, and one walked up to a group of black kids and dropped an N bomb. How can anyone defend this town?

Really? I thought the "hoax" was about the inept media, the politically motivated prosecutors, the untrustworthiness of exotic dancers, and the fine young men hiring "the working girls" and assuming such actions would have no consequences.

The recent FBI and Justice Department study concluded the following:

Blacks are an estimated 39 times more likely to commit violent crime against a white person than vice versa, and 136 times more likely to commit robbery. (If decent black folks have trouble hailing a cab, and they do, these numbers may help explain it.)
Black-on-white rape is 115 times more common than the reverse.
What do these statistics tell us? The real repository of racism in America -- manifest in violent interracial assault, rape and murder -- is to be found not in the white community, but the African-American community. In almost all interracial attacks, whites are the victims, not the victimizers.

However, it wasn't prosecuted because it failed to meet federal standards required for the teens to be certified as adults."

Well, Steve, why suggest, "move along, there's nothing to see here..." when the "facts" don't seem to align with your interpretation of events? At least rap is an opportunity, e.g. for young black criminals to further their criminal careers. Rap needs only four things to be successful:
